Terms and Conditions of Use

These Terms and Conditions (the "Terms") govern access to and use of the website www.alyp.studio and of the free public-procurement alert service (the "Service") offered by Alyp Studio (3-102-830512 Sociedad de Responsabilidad Limitada, corporate ID 3-102-830512). By using the site or signing up for the Service, you accept these Terms. If you do not agree with them, please do not use the site or the Service.

1. Description of the Service

The Service consists of sending, by email and free of charge, notices about procurement processes published on the official SICOP system (sicop.go.cr) that match the categories of interest selected by the user. The Service is a courtesy of Alyp Studio and is provided for informational purposes.

2. Informational nature — no warranty of completeness or accuracy

2.1. Alyp Studio is not a public entity and has no official relationship with SICOP, the Costa Rican State or its institutions.

2.2. The information in the alerts comes from public sources and is processed automatically. We do not warrant that the alerts are complete, accurate or timely, or that they cover every relevant procurement process. Omissions, delays or errors may occur.

2.3. The alerts are purely informational and do not replace the official source. It is the user's sole responsibility to verify, validate and participate directly in SICOP and to comply with the deadlines and requirements of each procedure.

2.4. Alyp Studio does not advise on participation in procurement processes and does not guarantee any outcome derived from use of the Service.

3. Sign-up and user data

3.1. To activate the Service you must provide truthful, current information (company name, email address, mobile number and categories of interest) and accept the Privacy Policy.

3.2. You are responsible for the accuracy of the data you supply and for keeping the associated email account confidential.

3.3. Sign-up involves a double opt-in confirmation process: alerts are activated only after you confirm your email address.

4. Acceptable use

The user undertakes not to:

  • Use the Service for unlawful or unauthorised purposes.
  • Register third-party data without their consent.
  • Attempt to breach, overload or interfere with the security or operation of the site or the Service.
  • Reproduce, resell or redistribute the Service or its content for commercial purposes without written authorisation from Alyp Studio.

5. Intellectual property

The site and its design, trademarks, logos, texts and other content are the property of Alyp Studio or of their respective owners and are protected by applicable law. No licence over them is granted other than the one required for normal use of the site and the Service. Procurement information is public in origin and belongs to its respective sources.

6. Availability and changes to the Service

6.1. We aim to keep the Service available, but it may be interrupted by maintenance, technical failures or causes beyond our control. We do not guarantee uninterrupted availability.

6.2. Because it is a free service, Alyp Studio may modify, suspend or discontinue the Service (in whole or in part) at any time without incurring any liability. We will try to give reasonable notice whenever possible.

7. Limitation of liability

To the maximum extent permitted by law, Alyp Studio shall not be liable for direct, indirect, incidental or consequential damages arising from: (i) the use of, or inability to use, the Service; (ii) business or bidding decisions based on the alerts; (iii) omissions, errors or delays in the information; or (iv) interruptions of the Service. The Service is provided "as is" and "as available".

8. Unsubscribing

You may stop using the Service at any time by using the unsubscribe link at the foot of any alert or by writing to info@alyp.studio. See the details in the Privacy Policy.

9. Data protection

The processing of your personal data is governed by our Privacy Policy, in accordance with Costa Rican Act No. 8968.

10. Changes to these Terms

We may update these Terms. The version in force will always be published on this page together with its "last updated" date. Continued use of the Service after a change implies acceptance of the new Terms.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute shall be submitted to the competent Costa Rican courts, without prejudice to the rights granted to the user by consumer-protection or data-protection legislation.
